Private or exempt?
If your operation is classified as exempt or private by the Federal Motor Carrier Safety Administration and you don't hold for-hire operating authority, new regulations soon will require you to take extra steps to remain compliant.
Under the new Unified Registration System (URS), FMCSA will, for the first time, require all exempt and private carriers to designate agents for service of process in each state.
All exempt carriers also will have to provide evidence of financial responsibility, or insurance.
The insurance requirement also will apply to private carriers that haul hazardous materials as defined in Title 49, Part 172.101. This includes not only goods that commonly might be thought of as hazardous but also motorized equipment that uses fuel and many consumer items, including medicines that contain alcohol and nitroglycerin; paint products; certain pesticides and fertilizers and even many cleaners and health and beauty products.
URS takes effect on Jan. 17, 2017 for all carriers, including exempt and private. If you are an existing exempt or private carrier you must designate your agents for service of process by April 17, 2017. If you are an existing exempt carrier or private carrier hauling hazmat you must file evidence of financial responsibility by the same date.
